Right to withdrawal
RIGHT TO WITHDRAWAL MODES/TERMS OF OPERATION AND TIMING OF REIMBURSEMENT OF THE AMOUNT
Legislative Decree 6 September 2005, n. 206
a) The buyer has the right to terminate the contract, without penalty and without giving any reason, within 15 (fifteen) working days from the date of receipt.
The right to withdrawal must be exercised through the sending, within the deadline, of a communication to the e-mail address ordini@dancin.it or through the withdrawal form.
b)The buyer is also required to give to DANC’IN by MARCELLO RUGGIERO s.r.l., as its own expense, the product within the 15 (fifteen) working days from the date of receipt. For the purposes of the expiry of the limit time, the product is intented to be returned at the moment in which it is delivered to the post office or shipper.
c)Following the returning of the item , DANC’IN by MARCELLO RUGGIERO s.r.l., checks the order, laid down in the section “Further essential conditions to observe for the proper performance of the right of withdrawal”. It will be the DANC’IN by MARCELLO RUGGIERO s.r.l.’s task to inform via e-mail the buyer in the case in which following the verification it is established the failure to observe the further essential conditions.
d) The right of withdrawal will be considered regular and correct solely and exclusively if conducted in respect to the modalities and terms indicated in the provisions laid down in points: a) – b) – c)and without prejudice to the following further essential conditions.
In the case of regular and correct exercise of right of withdrawal by the buyer ,DANC’IN by MARCELLO RUGGIERO s.r.l.,within 30 (thirty) days from the date on which he came to the knowledge of the communication of withdrawal made through the WITHDRAWAL FORM or via e-mail, he provides to reimburse throgh bank transfer or paypar the amount received as remuneration for the purchasing of the product, delivery charges excluded.
FURTHER ESSENTIAL CONDITIONS TO OBSERVE FOR THE CORRECT EXERCISE OF THE RIGHT OF WITHDRAWAL
The right of withdrawal will be correctly and regularly deemed if they are respected even the following essential conditions:
– the product must be returned in the same packaging to which the product was delivered;
– the product must be returned in its substantial integrity and it must not show damage and/or discrepancy of any kind;
– the product could not have been, or even appear used.
– in the event that the product is equipped with the tag “article-description”, this tag should not be removed, namely rigged.
EFFETTI
a) With the receipt by DANC’IN by MARCELLO RUGGIERO s.r.l., of the WITHDRAWAL FORM and after strict compliance by the buyer of both the prescribed period for the sending of this form and the refund of the product, and of the further essential conditions, the Contracting Party are out of their obligations arising from the sales contract.
b) In cases where the prescription of the right of withdrawal are not fulfilled, the buyer doesn’t have the right of withdrawal of the amount of the purchasing of the product.
